Apple's UK appeal against iPad design ruling is rejected

The High Court in London has rejected Apple’s appeal against a ruling that Samsung hadn’t infringed its iPad design. Samsung won the original case in July with a judge deciding the Samsung Galaxy Tab range was “not as cool” as the Apple iPad’s appearance. Part of the ruling involved Apple running advertisements saying that Samsung hadn’t copied its designs.

One of the three Court of Appeal judges, Sir Robin Jacob, made a point of saying the new ruling is not about whether Samsung copied the iPad. “The issue is simply whether the accused design is too close to the registered design according to the tests laid down in the law.”

In dismissing Apple’s appeal the judges agreed that Apple would only need to link from its website to details of the ruling for one month rather than the six months originally ordered.

Apple still has an option of appealing to the UK Supreme Court.
