Australia decides that 'dopi' isn't a confused iPod

IP Australia, the government body that administers patents and trade marks in Australia, has ruled that the 'Digital Options and Personalised Items' (dopi) brand of iPod cases doesn't infringe Apple's iPod trade mark

In a recent trademark tribunal hearing, trademarks registrar Michael Kirov said Apple hadn't demonstrated that a "person of ordinary intelligence and memory" would assume a product name ending in 'i' indicated an official Apple product.

He noted that "it clearly cannot have escaped the applicant’s attention that the trade mark also happened to be made up of the letters of the opponent’s well known IPOD mark in reverse order" but ruled the 'dopi' trade mark wasn't "deceptively similar" to the iPod trade mark.
